You will go through either a contested or an uncontested divorce

On Behalf of | Jul 11, 2019 | Divorce

Getting divorced is a not a black-and-white process. The reason for this is that your divorce circumstances are not the same as those of other married couples who are seeking divorce. For instance, whereas other couples may have to go through contested divorces, you and your spouse may be able to take advantage of uncontested divorce in Texas.

Contested divorce is where both parties cannot come to an agreement on how to resolve their divorce issues. In this situation, they must go to trial, where a judge will assess their situation and decide for them how to resolve it. Unfortunately, sometimes, the judge’s decisions regarding spousal support or property division, for example, are not in alignment with what one or both of the parties would have wanted.

With uncontested divorce, however, you and your spouse can decide to settle your divorce matters outside of court by using a process known as mediation. The benefit of mediation is that it puts you and your future ex-spouse in control when it comes to tackling your legal disputes. This alternative dispute resolution process may be especially helpful if you have young children, as it tends to be less stressful than traditional divorce litigation.

If you end up having to go through the contested divorce process, an attorney can represent you in court, making sure that your rights are protected. Meanwhile, if you are going through an uncontested divorce, the attorney can advocate for you during the process of mediation. Either way, your attorney will strive to help you to achieve the most personally beneficial divorce process outcome possible in Texas.
