Study suggests divorce filings rise in January

A Texas couple starting the new year with the decision to end their marriage may not find themselves alone. Data from a recent study suggests that the number of individuals filing for divorce begins to rise in January. The rate then lowers, only to rise again in March and later in August, after which it begins to decline -- a trend suggesting that, among other reasons, parents try their best to time a divorce to coincide with a time in the year when their children's lives are most stable. 

Once a divorce is final, it makes sense to scrutinize the paperwork -- including the judgment of divorce -- in order to prioritize anything that needs to be done and make to notes of the respective deadlines. It is essential to complete these tasks in a timely manner, as there may be legal repercussions for failing to comply. It's also important to update health-care directives and powers of attorney. In fact,while the proceedings are pending, a power of attorney designating a family member or trusted friend as agent may be appropriate. Then, in the event that the individual becomes incapacitated before the divorce is finalized, the agent can be relied on to make those important decisions, instead of the soon-to-be ex.

Another crucial step during a divorce is closing joint accounts. It is recommended to begin this as early as possible, as it can take time to clear outstanding checks and move all recurring debits to new accounts. A great way for someone to protect themselves financially is to ask one's bank to grant withdrawals only if both spouse's signatures are provided -- this way, the bank knows that a divorce has taken place, and neither party can unilaterally withdraw money.  

Every divorce -- even the most amicable -- may bring hidden emotions to the surface. These kinds of difficulties have the potential to multiply exponentially if the divorce becomes contentious.
