Alimony and Spousal Support

Texas courts will not order alimony; but will, in certain situations, award "post-divorce maintenance." For a variety of reasons, such as caring for children, a party to a lengthy marriage may be absent from the job market for such a time that the he or she is unlikely to find employment that will provide for his or her needs. Also, a child may require such attention from one or the other parent that parent is precluded from working outside the home. In these cases, and others, Texas courts may order the other spouse to pay spousal maintenance.

Also, post-divorce maintenance can be arranged contractually. Many couples find that a monthly payment from one spouse to another is a convenient way of settling questions regarding division of the marital estate.
